أصدر المجلس العسكرى مرسوماً بتعديل أحكام القانون 38 والقانون 120 المتعلقان بمجلسى الشعب والشورى، على أن تجرى الانتخابات يوم 28 نوفمبر وتنعقد أولى جلسات مجلس الشعب 17 مارس.
ووفق المرسوم تستبدل نصوص المواد الأولى "فقرة أولى"، والثالثة "الفقرة الأولى والثانية والثالثة والخامسة"، والتاسعة "فقرة أخيرة" من القانون رقم 38 لسنة 1972 فى شأن مجلس الشعب، بالنصوص الآتية:
المادة الأولى "فقرة أولى":
يتألف مجلس الشعب من "498" عضوا يختارون بطريقة الانتخاب المباشر السرى العام على أن يكون نصفهم على الأقل من العمال والفلاحين.
وتنص المادة الثانية "الفقرات: الأولى والثانية والثالثة والخامسة"، "فقرة أولى": يكون انتخاب ثلثى أعضاء مجلس الشعب، بنظام القوائم الحزبية المغلقة، والثلث الآخر النظام الفردى، ويجب أن يكون عدد الأعضاء الممثلين لكل محافظة عن طريق القوائم الحزبية المغلقة مساوية لثلثى عدد المقاعد المخصصة للمحافظة، وأن يكون عدد الأعضاء الممثلين لها عن طريق الانتخابات الفردى مساويا لثلث عدد المقاعد المخصصة لها.
"فقرة ثانية"
تقسيم جمهورية مصر العربية إلى "46" دائرة تخصص الانتخاب بنظام القوائم.
"الفقرة الثالثة"
كما تقسم الجمهورية إلى "83" دائرة أخرى تخصص للانتخاب بالنظام الفردى، ينتخب عن كل دائرة منها عضوان يكون أحدهما على الأقل من العمال والفلاحين.
"فقرة خامسة"
ومع مراجعة حكم المادة السادسة عشرة من هذا القانون يجب أن يكون عدد المرشحين على أى من القوائم مساويا لثلثى عدد المقاعد المخصصة للدائرة، على أن يكون نصفهم على الأقل من العمال والفلاحين، ويراعى ألا يلى مرشح من غير العمال والفلاحين مرشحا من غير هؤلاء، وفى جميع الأحوال يجب أن تتضمن كل قائمة مرشحا من النساء على الأقل.
المادة التاسعة "فقرة أخيرة"
ولكل حزب تقدم بقائمة فى الدائرة الانتخابية أن يمارس الحق المقرر فى الفقرتين السابقتين لمرشحه المدرج اسمه فى الكشف المخصص لمرشحى القوائم.
"المادة الثانية"
يضاف إلى القانون رقم 38 لسنة 1972 المشار إليه مادة جديدة رقمها الخامسة عشرة مكررا نصها الآتى:
المادة الخامسة عشر "مكررا":
إذا أسفر توزيع المقاعد بناء على نتيجة الاقتراع، عن عدم استكمال نسبة العمال والفلاحين فى أى دائرة من دوائر القوائم، تستكمل النسبة من القائمة الحاصل أعضاؤها المنتخبون على أقل معامل انتخابى بالدائرة وبالترتيب الوارد فى تلك القائمة.
ويحسب المعامل الانتخابى بقسمة عدد الأصوات التى حصلت عليها كل قائمة فى الدائرة على عدد الأعضاء المنتخبين منها.
"المادة الثالثة"
يستبدل نصوص المواد 1 "فقرة أولى"، و 2 "الفقرات: الأولى والثانية والثالثة والخامسة"، و9 "فقرة أخيرة"، من القانون رقم 120 لسنة 190 بشأن مجلس الشورى، النصوص الآتية:
المادة 1 "فقرة أولى":
يتألف مجلس الشورى من "270" عضوا.
المادة 2 "الفقرات: الأولى والثانية والثالثة والخامسة:
"فقرة أولى":
يكون انتخاب ثلث أعضاء مجلس الشورى المنتخبين، بنظام القوائم الحزبية المغلقة، والثلث الآخر بنظام الانتخاب الفردى، ويجب أن يكون عدد الأعضاء الممثلين لكل محافظة عن طريق القوائم الحزبية المغلقة مساويا لثلثى عدد المقاعد المخصصة للمحافظة، وأن يكون عدد الأعضاء الممثلين لها عن طريق الانتخاب الفردى مساويا لثلثى عدد المقاعد المخصصة لها.
"فقرة ثانية":
تقسم جمهورية مصر العربية إلى "30" دائرة تخصص للانتخاب بنظام القوائم.
"فقرة ثالثة":
كما تقسم الجمهورية إلى "30" دائرة أخرى تخصص للانتخاب بنظام الفردى، ينتخب عن كل دائرة منها عضوان يكون أحدهما على الأقل من العمال والفلاحين.
"فقرة خامسة":

يشترط فيمن يتقدم بطلب الترشيح لعضوية مجلس الشعب أو مجلس الشورى بنظام الانتخاب الفردى، ألا يكون منتميا لأى حزب سياسى، ويشترط لاستمرار عضويته أن يظل غير منتم لأى حزب سياسى، فإذا فقد هذه الصفة أسقطت عنه العضوية بأغلبية ثلثى أعضاء المجلس.
"المادة السادسة":
ينشر هذا المرسوم بقانون فى الجريدة الرسمية، وتكون له قوة القانون ويعمل به اعتبارا من اليوم التالى لتاريخ نشره.

Article IX, "last paragraph"
Each party submitted a list in the electoral district may exercise the right decision in the preceding paragraphs of the candidate named in the disclosure of the ad hoc lists of candidates.

In addition to Law No. 38 of 1972 referred to a new article numbered fifteen bis to read the following:
Article XV, "bis":
If, after the distribution of seats based on the outcome of the ballot for failure to complete the percentage of workers and peasants in any department of the menus, complemented by winning percentage from the list members elected to the lower coefficient of electoral constituency and the order contained in that list.
The coefficient is calculated by dividing the number of electoral votes obtained by each list in the constituency, the number of elected members of it.
"Article III"
Replaces the provisions of Articles 1, "first paragraph," and 2 "paragraphs: the first, second, third and fifth," and 9 "last paragraph", of Law No. 120 of 190 on the Shura Council, the following texts:
Article 1, "first paragraph":
Consultative Council consists of "270" members.
Article 2 "paragraphs: the first, second, third and fifth:
"First paragraph":
The election of one third of the Shura Council, the elected, the system closed lists, and one third election system individual, must be the numbers of representatives for each province by closed lists is equal to two-thirds of the number of seats allocated to the province, and that the number of members representing them by individual election equal for two-thirds of the number of seats allocated to them.
